Fuse — Terms of Service

Overview

These Terms of Service ("Terms") govern your use of the Fuse application ("Fuse," "the App") provided by Dasan LLC ("Dasan," "we," "us," or "our").

By downloading, installing, or using Fuse, you agree to these Terms. If you do not agree, do not use the App.


1. The Service

Fuse is a personal health and fitness coaching application that connects to your wearable devices and fitness trackers to provide unified readiness coaching, recovery recommendations, and training insights.

1.1 Beta Status

Fuse is currently in beta. During beta: - Features may change, be added, or removed without notice - The App may experience bugs, downtime, or data inconsistencies - Beta users agree to provide feedback to help improve the product - Beta access may be limited or revoked at Dasan's discretion

1.2 Not Medical Advice

FUSE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

All content, recommendations, scores, and coaching outputs from Fuse are for general wellness and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you read or see in Fuse.

If you are experiencing a medical emergency, call 911 or your local emergency services immediately.


Health and Medical Information

Fuse provides AI-powered health coaching ("Phil") for informational and wellness purposes only.

Phil is not a medical professional. Information provided by Phil: - Is based on peer-reviewed research in our Science-Based Coaching Repository (SBCR) - Is not a substitute for professional medical advice, diagnosis, or treatment - Should not be used to make decisions about prescription medications without consulting your doctor - May not account for your complete medical history or individual circumstances

Always consult a qualified healthcare provider before: - Changing any prescribed medication (timing, dose, or discontinuation) - Starting a new supplement regimen if you have a medical condition - Making training decisions following surgery or injury - Acting on any recommendation that conflicts with advice from your physician

If Phil gives you advice that seems incorrect, please report it to support@fuse.fit. We take coaching quality seriously and review all flagged recommendations.

Fuse will provide account credits when we determine a coaching error occurred.


2. Eligibility

You must be: - At least 18 years old - A human (no bots or automated scripts) - Legally able to enter into this agreement in your jurisdiction

By using Fuse, you represent and warrant that you meet these requirements.


3. Account

3.1 Registration

To use Fuse, you must create an account. You agree to: - Provide accurate, current, and complete information - Maintain and update your information as needed - Keep your password secure - Notify us immediately of any unauthorized use of your account

You are responsible for all activity under your account.

3.2 Termination

Dasan may suspend or terminate your account at any time for: - Violation of these Terms - Fraudulent, abusive, or illegal activity - Extended inactivity (defined as 12+ months with no app usage) - At our sole discretion with reasonable notice

You may delete your account at any time from within the App or by contacting hello@fuse.fit.


4. Third-Party Integrations

Fuse connects to third-party wearable platforms (Oura, Whoop, Polar, Withings, Strava) via OAuth authorization. By connecting these integrations: - You authorize Fuse to access data from those platforms within the permissions you grant - You acknowledge that those platforms have their own terms and privacy policies - You understand that Dasan is not responsible for the availability, accuracy, or continuity of third-party data

Dasan is not affiliated with Oura, Whoop, Polar, Withings, or Strava except as an independent developer using their public APIs.


5. Subscriptions and Payments

5.1 Free Beta

During the beta period, Fuse is free to use. No payment is required.

5.2 Future Subscription

When Fuse launches publicly, access will require a subscription. At that time: - Subscription pricing will be disclosed in the App before purchase - Payments are processed through Apple In-App Purchase (iOS) or Stripe (web) - Subscriptions auto-renew unless cancelled before the renewal date - Cancellation is effective at the end of the current billing period; no prorated refunds - Apple's refund policies apply to App Store purchases

5.3 Price Changes

We will provide 30 days' notice of any price changes via in-app notification and email.


6. Acceptable Use

You agree NOT to: - Reverse engineer, decompile, or attempt to extract the App's source code - Use the App for any illegal purpose - Share your account credentials with others - Use automated tools to scrape, harvest, or extract data from the App - Interfere with or disrupt the App's infrastructure - Upload any content that is illegal, harmful, or infringes on third-party rights - Use the App in any way that could harm other users or Dasan


7. Intellectual Property

All content, code, algorithms, and design in Fuse are the property of Dasan LLC. Nothing in these Terms grants you any ownership rights.

You retain ownership of your personal data. By using Fuse, you grant Dasan a limited, non-exclusive license to process your data solely to provide the service described in these Terms and our Privacy Policy.


8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Dasan does not warrant that: - The App will be uninterrupted or error-free - Results obtained from the App will be accurate or reliable - Health recommendations will be appropriate for your specific situation

USE OF HEALTH AND FITNESS DATA FROM FUSE IS AT YOUR OWN RISK.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Some jurisdictions do not allow limitation of liability for certain damages — if this applies to you, those limitations may not apply.


10. Indemnification

You agree to indemnify and hold harmless Dasan LLC, its members, directors, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from: - Your violation of these Terms - Your use of the App - Your violation of any third-party rights


11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.


12. Dispute Resolution

For any dispute with Dasan, you agree to first contact us at hello@fuse.fit and attempt to resolve the issue informally for at least 30 days before initiating formal proceedings.


13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via: - In-app notification - Email to your registered address - Updated "Effective Date" at the top of this document

Continued use after changes constitutes acceptance.
